Kyle's Case: Summary of Police Allegations
A police officer was dispatched to a post-secondary school campus the day after a reported assault had taken place. Upon arriving on campus, an officer spoke with the young woman who had been assaulted. The officer was told that a very drunk male, Kyle, had knocked on her residence room door the previous evening. The complainant said that she asked the male to leave, and he said that he wanted his jacket. According to the young woman, she tried to physically prevent the man from entering her room before she was pushed and punched in the face. She says that she was able to remove the male from the room and shut the door after she had been punched.
The officer got a description and a written statement from the complainant. Afterwards, the officer spoke with the manager of the residence that had been on duty during the incident. The manager was aware of the incident and explained to the officer that the suspect had been identified by security through video surveillance. The suspect was identified as Kyle.
The officer believed that there were sufficient grounds to arrest and charge Kyle with assault.
The officer located Kyle in his residence room, told him he was under arrest for assault and that he would be released with an appearance notice. He was given his right to counsel and he advised police that he wanted the number for duty counsel. He said he would call after the police officers left.
