Chantal's Case: Summary of Police Allegations

On seven occasions, Chantal was seen entering Walmart empty handed.  Each time, after a few minutes, she appeared at the customer service desk to return store merchandise.  She was given a refund in the form of a store gift card.  Chantal was later seen re-entering the store and purchasing more items.

Each time Chantal returned to Walmart, she returned store merchandise that she did not purchase but these items were the same or similar to those that she had previously purchased.  She presented receipts and received gift cards in return.

On the fifth day that Chantal returned items at Walmart, a loss prevention officer was alerted to her activities.  He performed an investigation and using receipt and gift card numbers, the officer was able to trace back her purchases and returns.  He also viewed footage from the store video surveillance for the dates that Chantal was in the store.

Two days after the loss prevention officer investigated Chantal’s activities, he observed her enter the store empty handed and select two items.  She then proceeded to the customer service desk where she attempted to return the items using a receipt.  As usual, she received the refund on a store gift card.  After Chantal signed the receipt, the loss prevention officer placed her under arrest.  She was brought to the loss prevention office where the officer read her rights to counsel.

A police officer arrived and agreed that the arrest was lawful.  Chantal was released on an appearance notice for fraud under $5000 and was escorted out of the store.
